Terms of Service
1. Acceptance of Terms
By accessing or using the Lund Lumber AI Estimator™ (LLAIE™) platform, you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.
2. Subscription & Billing
LLAIE™ is offered on a subscription basis. Fees are billed monthly or as agreed upon at signup. Failure to pay may result in suspension of access. All sales are final unless otherwise agreed in writing.
3. Permitted Use
You may use LLAIE™ solely for your internal business purposes related to lumber estimating and construction bidding. Use is limited to the company that is registered with LLAIE™. You may not resell, sublicense, share access, or redistribute the platform or its outputs to any third party without written consent from Richard Timothy Lund / LLAIE™.
3a. No Sublicensing or Resale
Sublicensing, reselling, white-labeling, or otherwise providing access to LLAIE™ — or any estimates, takeoffs, or outputs generated by LLAIE™ — to any person or company not registered as the licensed subscriber is strictly prohibited. Any such activity without a written permit issued by LLAIE™ / Richard Timothy Lund constitutes a material breach of these Terms and may result in immediate account termination and legal action under the laws of the State of Texas, Dallas County jurisdiction.
3b. VIP Plan — Registered Companies Only
The VIP plan is available exclusively to companies that are formally registered with LLAIE™. Access is non-transferable. The registered company may not share, resell, or sublicense VIP access or its benefits to any other company or individual without express written authorization from LLAIE™.
4. AI-Generated Estimates
AI-generated estimates are provided as a starting point and may contain errors. LLAIE™ does not guarantee the accuracy of any estimate. You are solely responsible for verifying all material quantities, pricing, and compliance before submitting bids or placing orders.
5. Termination
We reserve the right to suspend or terminate your account at any time for violation of these terms, non-payment, or misuse of the platform. Upon termination, your data may be retained for 90 days before deletion.
6. Limitation of Liability
LLAIE™ and Richard Timothy Lund shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including lost profits, project losses, or estimation errors. To the maximum extent permitted by applicable law, total aggregate liability is limited to fees paid in the 3 months preceding the claim.
6a. Indemnification
You agree to indemnify, defend, and hold harmless Richard Timothy Lund, LLAIE™, and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including attorney's fees) arising from: (a) your violation of these Terms; (b) your misuse of the platform; (c) your infringement of any third-party intellectual property rights; or (d) your sublicensing or resale of LLAIE™ without authorization.
7. Governing Law & Jurisdiction
These Terms are governed exclusively by the laws of the State of Texas, United States. Any disputes, claims, or legal proceedings arising out of or related to the use of LLAIE™ shall be brought exclusively in the state or federal courts located in Dallas County, Texas. Both parties irrevocably consent to personal jurisdiction and venue in Dallas County, Texas.
8. Venue — Dallas County, Texas
All lawsuits, arbitrations, or legal actions related to LLAIE™ must be filed and heard in Dallas County, Texas. The parties waive any right to transfer venue to another jurisdiction. This platform is operated from Dallas, Texas and all agreements are deemed to be entered into in Dallas County, Texas.
Privacy Policy
1. Information We Collect
We collect information you provide during registration (name, email, company), project data you upload (plans, line items), payment information processed via our payment provider, and usage data to improve the platform.
2. How We Use Your Information
Your data is used to provide and improve the LLAIE™ service, process payments, send account-related communications, and generate AI estimates. We do not sell your personal data to third parties.
3. Data Security
We implement industry-standard security measures including encrypted data transmission (TLS), secure cloud storage, and access controls. However, no system is 100% secure and we cannot guarantee absolute security.
4. Data Retention
We retain your data for as long as your account is active. Upon cancellation, data is retained for 90 days then permanently deleted. You may request deletion at any time by contacting support.
5. Third-Party Services
LLAIE™ uses third-party services including payment processors and cloud infrastructure providers. These services have their own privacy policies and we encourage you to review them.
6. Cookies
We use cookies to maintain your session and improve user experience. You may disable cookies in your browser, but some features may not function properly.
7. Jurisdiction for Privacy Disputes
Any disputes arising from this Privacy Policy shall be governed by the laws of the State of Texas and resolved exclusively in the courts of Dallas County, Texas.

Applicable Federal & Texas Laws
Overview
LLAIE™ is protected by a comprehensive set of federal and Texas state laws. Any unauthorized use, access, copying, reverse engineering, sublicensing, or resale of LLAIE™ software, algorithms, data, or outputs may expose violators to civil lawsuits and criminal prosecution under the following statutes.
17 U.S.C. § 101 et seq. — Copyright Act
LLAIE™ source code and creative works are protected under federal copyright law. Penalties: up to $150,000 per willful infringement (civil); up to 5 years imprisonment and $250,000 fine (criminal) under 17 U.S.C. § 506.
17 U.S.C. § 1201 — DMCA Anti-Circumvention
Bypassing LLAIE™ access controls, authentication, or technological protection measures is illegal. Penalties: civil damages of $200–$2,500 per act; criminal penalties up to $1,000,000 fine and 10 years imprisonment per 17 U.S.C. § 1204.
18 U.S.C. § 1030 — Computer Fraud and Abuse Act (CFAA)
Unauthorized access to LLAIE™ servers, databases, or user accounts is a federal felony. Penalties: 1–20 years imprisonment depending on offense severity; civil liability for damages and injunctive relief.
18 U.S.C. § 1836 — Defend Trade Secrets Act (DTSA)
LLAIE™ AI algorithms, estimation models, and proprietary data are federal trade secrets. Misappropriation penalties: injunctive relief, actual damages + unjust enrichment, exemplary damages up to 2x, attorney's fees. Criminal theft under 18 U.S.C. § 1832: up to $5,000,000 fine and 10 years imprisonment.
18 U.S.C. § 2510 & § 2701 — ECPA & Stored Communications Act
Unauthorized interception of LLAIE™ data transmissions or access to stored user communications is a federal crime under the Electronic Communications Privacy Act and Stored Communications Act. Penalties include criminal fines and imprisonment.
15 U.S.C. § 1051 et seq. — Lanham Act (Trademark)
LLAIE™ and "Lund Lumber AI Estimator™" trademarks are federally protected. Infringement penalties: injunction, actual damages, disgorgement of profits, treble damages for willful infringement, and attorney's fees under 15 U.S.C. § 1117.
Tex. Civ. Prac. & Rem. Code § 134A — Texas Uniform Trade Secrets Act (TUTSA)
Texas state trade secret law protects LLAIE™ proprietary algorithms and workflows. Remedies: injunctive relief, actual damages, unjust enrichment, exemplary damages up to 2x for willful misappropriation, and attorney's fees for bad-faith misappropriation.
Tex. Bus. & Com. Code § 17.41 et seq. — Texas Deceptive Trade Practices Act (DTPA)
Any person who fraudulently misrepresents LLAIE™-generated estimates or outputs as their own independent work to clients or third parties may be liable under the Texas Deceptive Trade Practices Act. Penalties include actual damages, up to 3x damages for intentional conduct, and attorney's fees.
Tex. Penal Code § 33.02 — Texas Harmful Access to Computers
Under Texas law, unauthorized access to LLAIE™ computer systems is a criminal offense. Penalties range from a Class B misdemeanor to a first-degree felony depending on the value of data accessed or the damage caused.
Restatement (Third) of Unfair Competition — Misappropriation
Beyond statutory protections, LLAIE™ proprietary data and methods are protected under the common law doctrine of misappropriation. Any commercial exploitation of LLAIE™'s proprietary outputs without authorization constitutes unfair competition actionable in Dallas County, Texas courts.
Enforcement & Remedies
Richard Timothy Lund / LLAIE™ reserves the right to seek all available legal remedies including: (1) immediate injunctive relief; (2) actual and statutory damages; (3) disgorgement of all profits; (4) exemplary/punitive damages; (5) attorney's fees and court costs; and (6) referral to federal and Texas law enforcement for criminal prosecution. All claims shall be pursued in Dallas County, Texas courts.
Texas Building Codes & Lumber Regulations
Texas Residential Construction Commission (TRCC)
All residential construction in Texas must comply with the Texas Residential Construction Commission standards. LLAIE™ references the International Residential Code (IRC) as adopted by Texas for framing, span tables, and load calculations.
International Residential Code (IRC)
Texas has adopted the IRC with state-specific amendments. Key lumber provisions include Chapter R802 (Roof-Ceiling Construction), Chapter R602 (Wall Framing), and Chapter R502 (Floor Framing). Builders must verify local jurisdiction adoptions.
Lumber Grading Standards
All lumber used in structural applications must meet grading standards set by the American Lumber Standard Committee (ALSC) and the Southern Pine Inspection Bureau (SPIB). Common grades include #1, #2, and Select Structural.
Span Tables & Load Requirements
Structural lumber sizing must comply with approved span tables per IRC Section R802 and R802.4. LLAIE™ AI estimates reference typical span requirements but a licensed engineer or architect must verify structural calculations for permit submission.
Dallas County & City of Dallas Permits
Construction projects in Dallas County must obtain permits through the City of Dallas Development Services Department (DSD) or the applicable municipality (e.g., Irving, Garland, Mesquite, Richardson). Dallas has adopted the 2021 International Residential Code (IRC) and 2021 International Building Code (IBC) with local amendments. All lumber takeoffs must be supported by stamped engineering drawings for permit submission in Dallas County.
Texas Contractor Licensing
Texas does not require a statewide general contractor license. However, the City of Dallas requires a Contractor Registration for work within city limits. Specialty trades (electrical, plumbing, HVAC) require state licensing. Dallas County contractors should verify current registration requirements at dallascityhall.com.

Federal Copyright Protection — 17 U.S.C. § 101 et seq.
LLAIE™ source code, user interface, documentation, and all original content are protected under the United States Copyright Act (17 U.S.C. § 101 et seq.). Unauthorized reproduction, distribution, display, or creation of derivative works is a federal civil and criminal offense punishable by up to $150,000 per willful infringement and up to 5 years imprisonment under 17 U.S.C. § 504–506.
Digital Millennium Copyright Act (DMCA) — 17 U.S.C. § 1201
LLAIE™ is protected under the Digital Millennium Copyright Act. It is unlawful to circumvent any technological protection measures (TPMs) used by LLAIE™ to control access to the software. Circumvention, trafficking in circumvention tools, or bypassing authentication systems is punishable by civil damages up to $2,500 per act and criminal penalties up to $1,000,000 and/or 10 years imprisonment under 17 U.S.C. § 1204.
Computer Fraud and Abuse Act (CFAA) — 18 U.S.C. § 1030
Unauthorized access to LLAIE™ systems, databases, servers, or backend functions is a federal crime under the Computer Fraud and Abuse Act (18 U.S.C. § 1030). This includes accessing accounts without authorization, scraping data, bypassing login controls, or exceeding authorized system access. Violations are punishable by federal imprisonment and significant civil liability.
Federal Trade Secret Protection — Defend Trade Secrets Act (DTSA) — 18 U.S.C. § 1836
The AI estimation algorithms, lumber takeoff models, pricing logic, machine learning training data, and proprietary workflows within LLAIE™ are trade secrets protected under the Defend Trade Secrets Act of 2016 (18 U.S.C. § 1836). Misappropriation may result in injunctive relief, damages equal to unjust enrichment, exemplary damages up to 2x actual damages, and attorney's fees. Criminal trade secret theft under 18 U.S.C. § 1832 carries penalties up to $5,000,000 and 10 years imprisonment.
Texas Uniform Trade Secrets Act (TUTSA) — Tex. Civ. Prac. & Rem. Code § 134A
In addition to federal protections, LLAIE™ trade secrets are protected under the Texas Uniform Trade Secrets Act (TUTSA), codified at Texas Civil Practice & Remedies Code § 134A. TUTSA provides for injunctive relief, actual damages, unjust enrichment recovery, and exemplary damages up to 2x for willful misappropriation. All TUTSA claims shall be brought in Dallas County, Texas.
Lanham Act — Trademark Protection — 15 U.S.C. § 1051 et seq.
LLAIE™ and "Lund Lumber AI Estimator™" are proprietary trademarks of Richard Timothy Lund, protected under the Lanham Act (15 U.S.C. § 1051 et seq.). Unauthorized use, imitation, or infringement of these marks in commerce is subject to injunctive relief, actual damages, disgorgement of profits, treble damages for willful infringement, and attorney's fees.
No Reverse Engineering — DMCA § 1201 & EULA
Reverse engineering, decompiling, disassembling, or attempting to derive the source code or underlying algorithms of LLAIE™ is strictly prohibited. This prohibition is enforceable under DMCA § 1201, the DTSA, TUTSA, and this End User License Agreement. Violations may result in immediate account termination and civil and/or criminal prosecution.
No Sublicensing or Resale Without Written Permit
Sublicensing, reselling, white-labeling, sharing access credentials, or distributing LLAIE™ or its AI-generated outputs to third parties without express written authorization from Richard Timothy Lund / LLAIE™ is strictly prohibited. Violation constitutes breach of contract, trade secret misappropriation, and copyright infringement, subject to all remedies available under federal and Texas law.
Electronic Communications Privacy Act (ECPA) — 18 U.S.C. § 2510
Unauthorized interception, monitoring, or access to LLAIE™ data transmissions or stored communications is prohibited under the Electronic Communications Privacy Act (18 U.S.C. § 2510 et seq.) and the Stored Communications Act (18 U.S.C. § 2701 et seq.).
User Content
You retain ownership of any project plans, data, or content you upload to LLAIE™. By uploading content, you grant LLAIE™ a limited, non-exclusive license to process that content solely to provide the service to you. You may not upload content that infringes third-party intellectual property rights.
AI-Generated Output
Estimates, takeoffs, and reports generated by LLAIE™ AI on your behalf are licensed to you for your registered business use only. They may not be redistributed, resold, sublicensed, or passed off as independently created without attribution and written authorization from LLAIE™.
DMCA Infringement Reporting
To report copyright infringement or intellectual property violations, contact: lundlumberai@gmail.com. We respond to all verified DMCA takedown notices within 5 business days. Repeat infringers will have accounts permanently terminated.
Legal Jurisdiction for IP Disputes
All intellectual property disputes, infringement claims, and trade secret violations related to LLAIE™ shall be adjudicated exclusively under the laws of the State of Texas in the state or federal courts of Dallas County, Texas. Unauthorized use of LLAIE™ intellectual property may result in civil and criminal liability under Texas state law and applicable federal law, including but not limited to: 17 U.S.C. § 101, 17 U.S.C. § 1201, 18 U.S.C. § 1030, 18 U.S.C. § 1032, 18 U.S.C. § 1836, 15 U.S.C. § 1051, and Tex. Civ. Prac. & Rem. Code § 134A.
